Article 1097. Terms of compensation for damage caused as a result of defects in a product, work or service.

1. Harm caused as a result of deficiencies in a product, work or service shall be reimbursed if it occurred during the established shelf life or life of the goods (work, service), and if the shelf life or life is not established, within ten years from the date production of goods (work, services). 2. Regardless of the time of injury, the damage is compensable if: in violation of the requirements of the law, the shelf life or service life is not established; the person to whom the product was sold, for which the work was performed or to which the service was rendered, was not warned about the necessary actions after the expiration date or service life and possible consequences if these actions were not performed or he was not provided with complete and reliable information about the product ( work, service).
